Buyer beware: XCP titles still on store shelves
Chicago Tribune: Copy-protected Sony CDs still in stores despite recall. I was afraid this would happen, and said as much during my radio interview last week. It’s one thing to make a statement that you’re doing a recall, quite another to actually put the effort into ensuring that the channel gets the discs returned. Net: a lot more people are going to get corrupted computers this holiday season.

Worse than that, who is going to avoid that Sony sells the replaced XCP CDs in secondary markets like the Third World where the consumer is by far less aware and less protected?

It would be simple for Sony to get the message out to everyone who has the rootkit, if they wanted to … unfortunately that’s a “big if”. The truth is, and despite Cary Sherman’s of the RIAA’s self-serving rhetoric, Sony did wrong and, furthermore, does not want to make things right.
“As it turns out, there’s a clear solution: A self-updating messaging system already built into Sony’s XCP player. Every time a user plays a XCP-affected CD, the XCP player checks in with Sony’s server. As Russinovich explained, usually Sony’s server sends back a null response. But with small adjustments on Sony’s end — just changing the output of a single script on a Sony web server — the XCP player can automatically inform users of the software improperly installed on their hard drives, and of their resulting rights and choices.”

I, for one, will not anytime soon buy the music of any artist signed by Sony. If Sony’s contracted recording artists, along with with consumers of their music, felt obliged to either boycott Sony or find another record label, the lesson Sony (and others with similar motives) needs to learn would be all the more focused.
So, visit your favorite Sony recording stars’ web sites and let them know that Sony has also done them a great disservice. I may have missed it, but it seems precious few of Sony’s recording artists have spoken out about this. This is a case of: “If you’re not part of the solution, then you’re a part of the problem.”
